These Terms & Conditions apply to services provided by Ahmet Kocagoz operating as a sole trader under the Kozgrid brand.
1. Services
Kozgrid provides residential building design, drafting, documentation and project coordination services. Depending on the agreed scope, services may include concept design, Revit modelling, existing-condition drawings, proposed floor plans, elevations, sections, demolition plans, additions and alterations, secondary dwellings, residential ancillary structures, and documentation prepared for CDC or DA assessment.
The exact deliverables, purpose, fee and inclusions for each project are set out in the relevant quotation, proposal or written scope.
2. Approval pathways
Kozgrid may prepare and coordinate documentation for Development Application (DA) or Complying Development Certificate (CDC) assessment where appropriate. Kozgrid does not issue, certify or guarantee a CDC, development consent or other approval. Approval remains subject to applicable NSW planning controls, the National Construction Code, site constraints, supporting information and assessment by the relevant council, registered certifier or other approval authority.
The property owner is responsible for appointing the relevant certifier or approval authority where required.
3. Independent consultants and specialist services
Projects may require services from independent surveyors, structural or civil engineers, BASIX/NatHERS assessors, hydraulic or stormwater consultants, bushfire consultants, geotechnical engineers, arborists, certifiers or other specialists.
Unless specifically stated otherwise in writing, these services are not personally certified or provided by Kozgrid. Specialist advice, certification and declarations remain the responsibility of the appropriately qualified or registered practitioner engaged for that scope.
4. Professional boundaries
Kozgrid does not represent itself as an architectural practice, registered architect, registered certifier, surveying practice or engineering consultancy. Structural or civil engineering certification is not provided by Kozgrid unless separately undertaken by an appropriately qualified and registered practitioner within that practitioner's professional scope.
Kozgrid does not independently provide regulated design declarations for work requiring registered practitioners under the NSW Design and Building Practitioners framework unless the relevant practitioner requirements are satisfied for that specific service.
5. Client responsibilities
Clients must provide accurate and complete information relevant to the project, including available survey information, existing drawings, site information, client requirements and timely design decisions. Kozgrid may rely on information provided by the client and third parties.
Where accurate survey information or specialist reports are required, work may be paused or limited until that information is available.
6. Timing and revisions
Kozgrid aims to provide responsive communication and efficient turnaround. Any indicative timing, including targets of approximately 1–2 weeks for straightforward drawing packages, is an estimate only and begins once the required site information, survey and client design decisions are available.
Timing may change due to project complexity, client revisions, consultant input, approval requirements, third-party delays or changes to scope.
7. Fees and payment
All fees are in Australian dollars. Quotes are valid for 14 days unless stated otherwise. A deposit may be required before work begins. Additional work outside the agreed scope, including extra revisions or additional documentation, may be quoted separately.
Final deliverables may be withheld until amounts due have been paid in full.
8. Intellectual property
Unless otherwise agreed in writing, copyright in drawings, models and other material produced by Kozgrid remains with Ahmet Kocagoz. Upon full payment, the client receives a licence to use final deliverables for the agreed project and purpose.
Drawings or models must not be reused for another property or materially altered and relied upon without appropriate review.
9. Liability and third-party information
Kozgrid is not responsible for errors arising from inaccurate or incomplete information supplied by the client, consultants or other third parties, or for decisions made by approval authorities or certifiers.
Nothing in these Terms excludes, restricts or modifies rights or guarantees that cannot lawfully be excluded under the Australian Consumer Law.
10. Cancellation and termination
A client may cancel before work begins. Once work has commenced, the client is responsible for fees relating to work completed and committed costs. Kozgrid may suspend or terminate services where invoices remain unpaid, required information is not supplied, communication becomes unreasonable, or the requested scope falls outside the services Kozgrid can lawfully or competently provide.
11. Governing law
These Terms are governed by the laws of New South Wales, Australia. The parties agree to attempt reasonable direct resolution of disputes before commencing formal proceedings where appropriate.
