KOZGRID – Terms & Conditions

Welcome to KOZGRID. By accessing www.kozgrid.com.au and engaging services under the Kozgrid brand, you agree to the following Terms & Conditions.

1. Definitions

1.1 “We,” “our,” “us” refers to Ahmet Kocagoz, operating as a sole trader using the Kozgrid brand.

1.2 “Kozgrid” is a brand name only and does not represent a separate registered legal entity unless otherwise stated.

1.3 “You,” “client” refers to any individual or business engaging services.

1.4 “Services” refer to visualisation, concept design support, spatial studies, 3D modelling, and related design communication outputs.

2. Scope of Services

2.1 Concept Design & Visualisation

Kozgrid provides:

• Architectural visualisations
• Concept design support
• Spatial and layout studies
• Performance-informed visual exploration (light, ventilation, etc.)

All outputs are conceptual and illustrative only.

2.2 Nature of Work

Services are provided for:

• visual understanding
• communication of ideas
• early-stage design exploration

They are not technical documentation.

2.3 Exclusions

We do NOT provide:

• Registered architectural services
• Structural or engineering design
• Construction documentation
• Development Applications (DA)
• Complying Development Certificates (CDC)
• NCC/BCA compliance certification
• Building approvals or submissions
• Site supervision or project delivery

Clients must engage licensed professionals where required under Australian law.

3. Client Responsibilities

3.1 Accuracy of Information

Clients must provide accurate:

• dimensions
• site conditions
• drawings
• references

We are not liable for errors resulting from incorrect or incomplete information.

3.2 Use of Designs

All outputs are:

• for concept and visual purposes only
• not suitable for construction or approvals

Use for construction or submission is at the client’s own risk and must involve licensed professionals.

4. Fees & Payments

4.1 Pricing

• All prices are in AUD
• Quotes valid for 14 days unless stated otherwise
• GST included only if applicable

4.2 Payment Terms

• Deposit may be required before work begins
• Final deliverables released upon full payment
• Late payments may delay or suspend services

4.3 Refund Policy

• No refunds once work has commenced
• Partial refunds only if services cannot be completed
• Concept work is non-refundable once delivered

5. Intellectual Property

5.1 Ownership

All work produced remains the intellectual property of Ahmet Kocagoz, unless agreed otherwise.

5.2 Client Use

Clients receive a limited licence to:

• use final outputs for agreed purpose only

Clients may NOT:

• resell
• modify
• distribute
• claim authorship

without written consent.

6. Liability & Disclaimers

6.1 General Liability

We are not responsible for:

• construction outcomes
• third-party errors
• buildability issues
• design interpretation by others

6.2 Performance & Accuracy

Visuals may not reflect:

• exact materials
• real lighting conditions
• final construction outcomes

No guarantee is made regarding:

• approvals
• compliance
• performance

6.3 Third Parties

Any third-party consultants or contractors:

• are engaged at the client’s own risk
• are not affiliated with Kozgrid

6.4 Australian Consumer Law

Nothing in these terms excludes rights under the Australian Consumer Law (ACL).

7. Cancellation & Termination

7.1 Client Cancellation

• Cancellation allowed before work begins
• Deposits non-refundable once work starts

7.2 Right to Terminate

We may terminate services if:

• payments are overdue
• false information is provided
• scope exceeds legal service limits
• communication becomes unreasonable

Client must pay for work completed to date.

8. Governing Law & Dispute Resolution

8.1 Jurisdiction

These terms are governed by the laws of New South Wales, Australia.

8.2 Dispute Resolution

Parties agree to:

• attempt direct resolution
• proceed to mediation if required

before legal action.
